Soor Fuel Marketing Company has announced the issuance of a favorable cassation ruling in its legal case against the The National Infrastructure Projects Development Company (formerly Al-Kharafi National).
This ruling pertains to a debt claim related to the fuel supply card contract dated September 1, 2010.
In a statement provided to the Boursa Kuwait on Sunday, Soor detailed the provisions of the cassation ruling, which include:
First: The appeal was accepted, and the previous ruling was overturned, requiring the "National" company to bear the costs and pay 20 dinars in attorney fees.
Second: In Case No. 4299 of 2019 Commercial Appeal, the previous decision to deny the request for legal interest was annulled.
The ruling now requires the appellee company to pay the appellant legal interest at a rate of 7% per year on the awarded amount of 457,791.393 Kuwaiti Dinars (Four Hundred Fifty-Seven Thousand Seven Hundred Ninety-One Dinars and 393 Fils), along with costs and an additional two hundred dinars for attorney fees.
Third: In Appeal No. 4285 of 2019 Commercial, the appeal was rejected, and the appellant company was ordered to pay the related costs along with twenty dinars in attorney fees.
Soor expects that the financial impact from this ruling, once executed and the awarded amount received, will be recorded as additional revenue.
